Imubit, Inc. (“Imubit,” “we,” “our,” or “us”) respects your privacy, and we are committed to protecting it through our compliance with this policy. We are a company established in the United States with a registered office at 2700 Post Oak Blvd Suite 2300, Houston, TX 77056, and for the purpose of applicable data protection laws, we are the data controller. 2. Children Under the Age of 18
Our Services are not intended for children under 18 years of age. No one under age 18 may provide any information to or through the Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on our Services through any of features, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will make commercially reasonable efforts to delete that information. We collect different types of information about you, including information that may directly identify you, information that is about you but individually does not personally identify you, and information that we combine with our other users. This includes information that we collect directly from you or through automated collection technologies.

We collect several types of personal information from and about users of our Services, specifically information:

    • by which you may be personally identified, such as name, work address, billing address, e-mail address, telephone numbers, credit or debit card number, bank or financial information (for payment processing purposes), of you;
    • that is about you but individually does not identify you, such as traffic data, logs, referring/exit pages, date and time of your visit to our Services, error information, and other communication data and the resources that you access and use on the Services; or
    • about your Internet connection, the equipment you use to access our Services and usage details, such as traffic data, logs, referring/exit pages, date and time of your visit to our Services, error information, clickstream data, and other communication data and the resources that you access and use on the Services.

We collect this information:

    • directly from you when you provide it to us;
    • automatically as you navigate through the Services. Information You Provide to Us

We collect on or through the Services the following information which you provide to us:

    • Basic contact details, such as name, work address, email address, and telephone numbers;
    • Payment information, such as credit or debit card number, bank or financial information, and billing address;
    • Images and video of you;
    • Account information, such as username, password, and security questions that you select and the answers you provide;
    • Any other information you choose to include in communications with us, for example, when sending a message through the Services.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with the Services, we use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, specifically:

    • Usage Details. Details of your visits to the Services, such as traffic data, location, logs, referring/exit pages, date and time of your visit to the Services, error information, and other communication data and the resources that you access and use on the Platform;
    • Device Information. Information about your computer, mobile device, and Internet connection, specifically your IP address, operating system, browser type, and browser version information; and

    • Google Analytics. We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of the Platform. Google Analytics uses “cookies”, which are text files placed on your computer, to help the Platform analyze how users use the site. Information Collected From Other Sources

We obtain information about you from outside sources, including information that we collect directly from third parties and information from third parties that you choose to share with us. Such information includes:

    • Analytics data we received from analytics providers such as Google Analytics; and
    • Information we receive from career websites, such as LinkedIn.

Any information we receive from outside sources will be treated in accordance with this Privacy Policy. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices.

4. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

    • to perform our contract and provide our Services to you;
    • to provide you with information, products, or services that you request from us or that may be of interest to you, with your consent;
    • to create and maintain your Imubit account and provide you with notices about your Imubit account, as part of performing our contract with you;
    • to contact you in response to a request, with your consent;
    • to fulfill any other purpose for which you provide it, with your consent;
    • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
    • as a matter of our legitimate interests, to notify you about changes to our Services, or any products or services we offer or provide though them; and
    • in any other way we may describe when you provide the information, with your consent.

We may de-identify your personal information so that it no longer reasonably identifies you. In this case, we may use this de-identified data without restriction and for any purpose, including to improve our Services.

In addition to the specific uses described above, we may use any of the above information to provide you with the Services and to, as a matter of our legitimate interests, maintain our business relationship, including by enhancing the safety and security of our Services (e.g., troubleshooting, data analysis, testing, system maintenance, and reporting), providing customer support, sending service and other non-marketing communications, monitoring and analyzing trends, conducting internal research and development, complying with applicable legal obligations, enforcing any applicable terms of service, and protecting the Services, our rights, and the rights of our employees, users or other individuals.

    • to a company we merge, acquire, or that buys us, or in the event of change in structure of our company of any form, in our legitimate interests; and
    • to professional advisors, such as auditors, law firms, or accounting firms, in our legitimate interests.

We may also disclose your information as needed to comply with applicable law or any obligations thereunder or to cooperate with law enforcement, judicial orders, and regulatory inquiries, to enforce any applicable terms of service, and to ensure the safety and security of our business, employees, and users.

6. Do Not Track Signals

Your browser settings may allow you to transmit a “do not track” signal, “opt-out preference” signal, or other mechanism for exercising your choice regarding the collection of your information when you visit various websites. Like many websites, our website is not designed to respond to such signals, and we do not use or disclose your information in any way that would legally require us to recognize opt-out preference signals. 7. Data Security and Retention

Although we take reasonable efforts to try and protect your personal information as set out in our Data Security Policy (https://imubit.com/data-security-policy/), no security measures are impenetrable, and we cannot guarantee the security of any personal information transmitted through our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services or in your operating system. Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

The safety and security of your information also depends on you. Where you have chosen a password for the use of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We retain your information for as long as is reasonably necessary for the purposes specified in this Privacy Notice. 8. European and UK Users
Data Transfers

The information we collect from you may be stored and processed in countries outside the EU and UK. For any transfers of data from the EU or the UK, the data transfer will be under the European Commission’s model contracts for the transfer of personal data to third countries (i.e., the standard contractual clauses) or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined by the European Commission or the relevant UK authorities, as applicable, to provide an adequate level of protection for individuals’ rights and freedoms for their personal data. We disclosed personal information over the preceding 12 months for the following business or commercial purposes:

    • to maintain and secure your account with us
    • to process your payment, to provide you with products or services you have requested

We do not “sell” or “share” (as those terms are defined under the CCPA) personal information, nor have we done so in the preceding 12 months. Further, we do not have actual knowledge that we “sell” or “share” personal information of residents under 16 years of age.
